Terms and Conditions

These General Terms and Conditions of the www.tobaccostuff.net online store have been prepared in accordance with the Consumer Protection Act (ZVPot-1), the Electronic Commerce on the Market Act (ZEPT), the Personal Data Protection Act (ZVOP-2) and the General Data Protection Regulation (GDPR). By placing an order, the customer confirms that they are familiar with and agree to these Terms and Conditions.

The products in this online store are intended exclusively for persons over the age of 18. By placing an order, the customer confirms that they are at least 18 years old. We reserve the right to refuse an order if we have reasonable grounds to believe that this requirement has not been met.

Prices

All prices are stated in euros (EUR) and include value added tax. As we deliver to all European Union countries, orders delivered to another EU Member State are subject to the VAT rate applicable in the destination country under the OSS scheme. The price applicable to an order is the price displayed at the time the order is placed. Prices may change without prior notice, but such changes do not affect orders that have already been placed.

Delivery costs are not included in the product prices. They are calculated and displayed at checkout before you place your order.

Orders and conclusion of the contract

You can place an order through the www.tobaccostuff.net online store either as a guest or using a user account. The purchasing process consists of the following steps:

1. add products to your shopping cart,
2. enter your details at checkout and select your delivery and payment methods,
3. review the order summary and final amount before submitting the order,
4. place the order and receive an order confirmation and summary by email.

The sales contract is concluded when the customer receives the order confirmation by email. The contract is stored electronically at the registered office of Derma Op d.o.o., Kajuhova ulica 1, 8250 Brežice. You may request a copy at any time by emailing info@tobaccostuff.net or calling +386 41 369 983.

Some products are subject to a minimum purchase quantity. This is stated next to the relevant product and is automatically taken into account by the shopping cart. Certain products are also available as sets. A set is considered a single product with its own price and must be returned as a complete set.

Product availability

The availability of each product is displayed next to the product. Products that are out of stock cannot be added to the shopping cart. If, in exceptional circumstances, we are unable to dispatch an ordered product within the stated time, we will contact you using the contact details provided and agree on the available options (later delivery, replacement or refund).

Payment methods

The following payment methods are available:

• Credit or debit card – payment is processed on the secure website of the payment service provider Stripe. We do not receive or store your card details.
• Payment by pro forma invoice – a pro forma invoice containing payment details will be sent to your email address. The goods will be dispatched once the payment has been credited to our account. Any bank or transaction fees are payable by the customer. Please check the applicable charges with your bank or post office.
• Cash on delivery – payment is made to the delivery courier upon receipt of the shipment. Cash on delivery is available only for deliveries within Slovenia and is not available for personal collection.

Delivery

Goods are delivered by our contracted carrier GLS. We deliver to Slovenia and all other countries of the European Union.

Orders placed and paid for by 14:00 on a business day are normally dispatched on the same business day. Orders placed later, during weekends or on public holidays are dispatched on the next business day. For payments by pro forma invoice, the dispatch period begins once the payment has been credited to our account.

Estimated delivery time after dispatch:

• Slovenia: 1–2 business days,
• other European Union countries: 3–7 business days.

The estimated delivery date is also displayed next to each product and at checkout. Delivery times are estimates and may be extended accordingly during holiday periods. Goods sent on a cash-on-delivery basis remain the property of the sender until payment has been made.

Delivery costs

Delivery costs depend on the weight of the shipment and the destination country. Prices include VAT, and the exact amount is displayed at checkout before you place your order. The minimum charges for shipments weighing up to 2 kg are listed below:

Delivery costs are higher for heavier shipments and are calculated according to weight categories (up to 2 kg, up to 5 kg, up to 10 kg, up to 20 kg, up to 30 kg and over 30 kg).

Personal collection

You may also collect your order free of delivery charges at Kajuhova ulica 1, 8250 Brežice, Monday to Friday between 08:00 and 16:00. Personal collection is available only for orders with delivery in Slovenia and cannot be combined with cash-on-delivery payment.

We will notify you by email when your order is ready for collection. Goods will be handed over to the person specified as the recipient when the order was placed, upon presentation of an identity document.

Incorrect information and order cancellation

If, after placing your order, you realise that you entered incorrect information or wish to cancel the order, please notify us as soon as possible by calling +386 41 369 983 or emailing info@tobaccostuff.net. An order may be cancelled free of charge until it has been dispatched. If the order has already been paid for by card, the purchase price will be refunded to the same payment method.

Please include the following information in your message:

• customer's first and last name,
• order number,
• address specified when placing the order.

Right of withdrawal

The consumer has the right to withdraw from the contract within 30 days of receiving the goods without having to provide a reason for the decision. This exceeds the statutory withdrawal period of 14 days.

The withdrawal period begins on the day on which the consumer, or a third party designated by the consumer who is not the carrier, acquires physical possession of the goods. If several products ordered in a single order are delivered separately, the period begins upon receipt of the last product.

To exercise your right of withdrawal, notify us in writing at info@tobaccostuff.net or at Derma Op d.o.o., Kajuhova ulica 1, 8250 Brežice. You may use the form below, but this is not mandatory – any clear and unambiguous statement of withdrawal is sufficient.

Please return the received goods no later than 14 days after notifying us of your withdrawal, together with the invoice and accompanying documentation, to Derma Op d.o.o., Kajuhova ulica 1, 8250 Brežice, Slovenia. The consumer bears the direct cost of returning the goods. We do not accept cash-on-delivery returns.

Refunds

We will refund all payments received no later than 14 days after receiving notice of withdrawal. We will also refund the delivery costs up to the amount of the least expensive standard delivery option offered by us. We may withhold the refund until we have received the returned goods or until the consumer provides proof that the goods have been sent back.

The refund will be made using the same payment method used for the original payment unless expressly agreed otherwise. For cash-on-delivery payments, the refund will be made to the bank account provided by the consumer. The consumer will not incur any additional costs as a result of the refund.

Condition of returned goods

Please return the goods undamaged and in the same quantity, preferably in their original packaging. You may open and inspect the product only to the extent necessary to determine its nature, characteristics and functioning – in the same way as you would in a physical store. If the value of the product is reduced as a result of handling beyond what is necessary for this purpose, the consumer is responsible for the reduction in value.

The right of withdrawal does not apply to sealed goods that are not suitable for return for health protection or hygiene reasons where the seal has been broken after delivery (e.g. cigarette tubes and filters), or in other cases specified in Article 135 of ZVPot-1.

Lack of conformity and warranty

As the seller, we are liable for any lack of conformity of the goods that existed at the time of delivery and becomes apparent within two years of delivery. If the lack of conformity becomes apparent within one year of delivery, it is presumed to have existed at the time of delivery.

If the goods do not conform to the contract, the consumer may request repair or replacement, a proportionate reduction in price or withdrawal from the contract, in the order and under the conditions specified by ZVPot-1. Please report any lack of conformity to info@tobaccostuff.net, including a description of the defect and a copy of the invoice. We will respond as soon as possible and no later than within eight days.

In addition to the above rights, appliances – cigarette tube filling machines – are covered by a one-year manufacturer's warranty under the conditions specified in the warranty certificate supplied with the product. The warranty does not exclude or limit statutory liability for lack of conformity of goods.

Complaints

Complaints may be submitted to info@tobaccostuff.net or by post to Derma Op d.o.o., Kajuhova ulica 1, 8250 Brežice. Please include your order number and a description of the problem and, if possible, attach a photograph. We will respond to complaints no later than within eight days of receipt.

If the shipment is visibly damaged upon receipt, please report this immediately to both the courier and us so that we can submit a claim to the carrier.

Discount codes

From time to time, we offer discount codes in our online store (standard discounts, free delivery or 2 + 1 free promotions). The following conditions apply to their use:

• the code must be entered at checkout before placing the order,
• only one code may be used per order,
• the code is valid during the period and under the conditions specified with it,
• the value of the code cannot be redeemed for cash,
• in the event of withdrawal from the contract, only the amount actually paid will be refunded.

Customer ratings and reviews

Visitors may submit a rating and review for a product. Each review is checked before publication, and we publish reviews that are not offensive, misleading or unrelated to the product. We do not alter the content of published reviews and do not publish fake reviews.

As a review may also be submitted by a visitor who is not logged in, we do not verify whether the reviewer actually purchased the product from us. Published ratings therefore do not necessarily originate from verified purchasers.

User account

Purchases can be made as a guest or using a user account. Users are responsible for keeping their passwords secure and for all actions carried out through their accounts. If you suspect misuse, please notify us immediately. You may request deletion of your user account at any time by emailing info@tobaccostuff.net.

Alternative dispute resolution

In accordance with the Slovenian Alternative Dispute Resolution for Consumer Disputes Act (ZIsRPS), Derma Op d.o.o. hereby states that it does not recognise any provider of alternative consumer dispute resolution services as competent to resolve a consumer dispute that a consumer may initiate under this Act.

We aim to resolve any disputes amicably – please contact us at info@tobaccostuff.net. If an agreement cannot be reached, the court with appropriate subject-matter jurisdiction in the Republic of Slovenia shall have jurisdiction. Relations between the seller and the consumer are governed by the law of the Republic of Slovenia, without prejudice to the protection afforded to the consumer by mandatory provisions of the law of their country of residence.

Personal data protection

We process personal data in accordance with the GDPR and ZVOP-2. Details about the data we collect, the purposes for which it is collected, to whom it is disclosed and how long it is retained are described in our Privacy Protection policy. You can read more about cookies here.

Limitation of liability

We make every effort to ensure that the information on our website is accurate and up to date, but errors may occur, for which we apologise in advance. Product images are illustrative and do not guarantee product characteristics; the product description is authoritative.

Derma Op d.o.o. is not liable for occasional website downtime, possible inaccuracies in information or damage resulting from the use of inaccurate or incomplete information or from the unavailability of the website. This does not affect any liability that cannot be excluded under mandatory law.

Any use of images, logos and trademarks from this website without the written permission of their respective owners is prohibited.

Changes to the Terms and Conditions

We reserve the right to amend these Terms and Conditions and the content of the website. Each order is governed by the Terms and Conditions that were published at the time the order was placed.

These Terms and Conditions are effective from 1 September 2026.
